Comera Pay LLC is licensed and regulated by the Central Bank of the UAE as a Retail Payment Services provider (Category II) and Stored Value Facility issuer. Customer funds are held in a segregated account with a CBUAE-licensed bank, separate from Comera Pay’s operating funds and the Customer Data is held and managed in line with The UAE Federal Decree-Law No. 45 of 2021 which establishes a comprehensive framework for personal data protection. Comera Pay’s Obligations and Liability

Item Description
Service Availability Comera Pay will use reasonable efforts to ensure the Wallet is available and functioning, subject to scheduled maintenance and events outside its control.
System Errors Comera Pay is responsible for correcting transactions that fail or are processed incorrectly due to a system error attributable to Comera Pay, and will refund any incorrect charges or deductions.
Unauthorized Transactions Where an unauthorised transaction occurs and the customer has not acted fraudulently or with gross negligence (including failure to safeguard credentials as set out in Section 10), Comera Pay will investigate and, where appropriate, refund the customer in accordance with applicable regulatory requirements, customer liability rules, and supporting evidence
Dispute Investigation Disputed transactions reported by the customer will be acknowledged within 2 business days and investigated within 30 calendar days, in line with CBUAE Consumer Protection Standards.
Refund Timeframe Approved refunds will be credited to the customer’s wallet or nominated bank account within 15 business days of the dispute being resolved.
Limitation Comera Pay’s liability for losses arising from the customer’s breach of these terms, fraudulent conduct, or failure to safeguard credentials are subject to applicable laws, regulations, and customer protection requirements.

Cooling-Off Period

Cancellation Period Customers may cancel within 5 business days
Condition Only if no transactions have occurred
Regulatory Basis Subject to applicable regulatory requirements
Refund of Top-Up Balance If the customer cancels within the cooling-off period and the wallet has been topped up but no transactions have occurred, the full top-up amount will be refunded to the original funding source (debit card or bank account used for the top-up).
Refund Timeframe Refunds will be processed within 15 business days of the cancellation request being received and verified.
No Fees on Cancellation No cancellation fees will be charged where the customer exercises the cooling-off right in accordance with the conditions above.

Governing Law This Key Fact Statement and the Comera Pay Consumer Wallet service are governed by the laws of the United Arab Emirates, including regulations issued by the Central Bank of the UAE.
Jurisdiction Any dispute arising in connection with the Wallet shall be subject to the non-exclusive jurisdiction of the competent courts of the United Arab Emirates, without prejudice to the customer’s right to escalate complaints to Sanadak (the independent Financial Ombudsman Unit) as set out in Section 10.

All fees are inclusive of 5% VAT, where applicable. Please note these fees will be in addition to the standard processing fee charged by Mastercard/VISA. Foreign currency purchases and ATM cash withdrawals are converted into AED by the card scheme (Mastercard or Visa) using their applicable exchange rates on the day the conversion is made. In line with the UAE’s Value Added Tax (VAT) implementation from 1st January 2018, VAT at the rate of 5% will be levied on Fee and Charges and is inclusive herein, wherever applicable as per UAE law.
